Overview

Welcome to craknbam. In these Terms, "we", "us", and "our" refer to craknbam, a brand owned and operated by CRAKNBAM, a company registered in the  United States. craknbam runs this website and online store, together with all related content, features, tools, products, and services offered through it (the "Services"). Our store is hosted on Shopify, which supplies the platform that allows us to operate the Services.

These Terms of Service, along with the policies referenced in them — including our Privacy Policy, Refund Policy, and Shipping Policy — set out the rights and obligations that apply when you use the Services.

Please read them carefully. They contain important provisions affecting your legal rights, including disclaimers of warranty, limits on our liability, and the process you agree to follow before raising a payment dispute.

By browsing our store, interacting with the Services, or placing an order, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not accept them, please do not use the Services.

Section 1 — Eligibility and Your Account

By accepting these Terms, you confirm that you have reached the age of majority in the state, province, or country where you live.

To browse our store or complete a purchase, we may ask you for information such as your email address and your billing, payment, and shipping details. You confirm that everything you give us is accurate, current, and complete, and that you are entitled to provide it. The shipping address you enter is your responsibility; we are not liable for orders that are delayed, returned, or misdelivered because the address supplied was wrong or incomplete.

If you create an account, you are responsible for keeping your login details secure and for all activity that takes place under your account. Accounts may not be sold, transferred, assigned, or licensed to anyone else.

Section 2 — Our Products

We work hard to present our products faithfully. Even so, colours and finishes can look different on your screen depending on your device, display calibration, and the lighting where you are. Variation of this kind is normal and does not make a product defective or "not as described".

Our mahjong tiles carry custom artwork that is printed inside the tile and sealed beneath a clear protective layer — they are not hand-painted. Product descriptions are accurate to the best of our knowledge and may change at any time without notice. We may discontinue any product, and we may limit the quantity we sell to any individual, region, or jurisdiction at our discretion.

Section 3 — Orders

Submitting an order constitutes an offer to buy. craknbam may accept or decline any order, in full or in part, for any reason. No order is binding on us until we confirm acceptance, and we must have received and processed your payment before an order is accepted.

Please check your order carefully before you submit it. Once an order has been accepted and has entered processing, we may not be able to change the address or cancel it. If we decline, alter, or cancel an order, we will try to reach you using the email address, billing address, or phone number you provided at checkout.

Returns and exchanges are handled solely under our Refund Policy. You confirm that anything you buy is for your own personal or household use and not for resale or export.

Section 4 — Pricing and Payment

Prices, discounts, and promotional offers may change at any time without notice. The price that applies is the one shown at the moment you place your order, as recorded in your order confirmation email. Unless we state otherwise, listed prices exclude taxes, shipping, handling, and any customs or import charges, which are your responsibility where they apply.

You agree to supply payment information that is current, complete, and accurate. You represent and warrant that: (i) the payment details you provide are true and correct; (ii) you are authorised to use the payment method; (iii) your card issuer will honour the charges you incur; and (iv) you will pay all amounts due at the posted prices, including shipping and any applicable tax.

Section 5 — Shipping and Delivery

Any delivery timeframe shown anywhere on the Services is an estimate, not a guarantee. We are not liable for shipping delays outside our reasonable control, including those caused by carriers, customs inspection, severe weather, or other disruptions.

Once we hand a parcel to the carrier, title and risk of loss pass to you. Where tracking is available, it serves as evidence of dispatch and delivery. An order that the carrier confirms as delivered to the address you supplied is treated as fulfilled.

Section 6 — Disputes and Chargebacks

We would rather fix a problem than fight about one. Before you open a payment dispute or chargeback with your bank or card issuer, you agree to contact us first at support@craknbam.com and to give us a reasonable window — at least 7 days — to put things right. In practice almost every issue, whether a delay, a damaged item, or a question about an order, is resolved faster with us directly than through a bank dispute.

You acknowledge and agree that:

• Completing checkout means you accept these Terms and our Refund Policy, and that you have confirmed your order details and shipping address are correct.
• An order that was delivered to the address you gave us, and that matches its description, has been fulfilled as agreed.
• We keep order confirmations, tracking data, delivery confirmations, product descriptions, and our correspondence with you as the record of each transaction.
• Raising a chargeback for an order you received that matches its description, or raising one without first contacting us, is improper. Where that happens we may submit our records in response to the dispute, decline to accept future orders from you, and recover the costs and fees we incur, to the extent the law allows.

Nothing here removes any legal right you hold that cannot be waived, and we will always honour our Refund Policy and applicable consumer-protection law.

Section 7 — Intellectual Property

The Services — including all trademarks, brand elements, text, imagery, graphics, photography, video, audio, and the selection and arrangement of that material — belong to craknbam, its affiliates, or its licensors, and are protected by United States and international intellectual property law. Our tile artwork and pattern designs are created exclusively for craknbam.

These Terms allow you to use the Services for personal, non-commercial purposes only. You may not copy, distribute, modify, adapt, publicly display, republish, download, or transmit any material from the Services without our prior written permission. The craknbam name, logo, product names, and design marks are our trademarks. Shopify's name and logo are trademarks of Shopify. All other marks belong to their respective owners. Any right not expressly granted here is reserved.

Section 8 — Optional Third-Party Tools

We may provide access to third-party tools that we neither monitor nor control. These are offered "as is" and "as available" with no warranty of any kind. Using them is entirely at your own risk, and you should read the relevant provider's terms before you do.

Section 9 — Links to Other Sites

The Services may link to websites we do not run. We are not responsible for the content, accuracy, or practices of those sites, and we accept no liability arising from your use of them. Please review a third party's own terms and policies before dealing with them.

Section 10 — Relationship with Shopify

craknbam is powered by Shopify, which enables us to operate the Services. Every sale made through our store is made directly with craknbam ([LEGAL ENTITY NAME]). By using the Services you acknowledge that Shopify bears no responsibility for any aspect of a sale between you and craknbam, including any injury, damage, or loss connected to the products you purchase. You release Shopify and its affiliates from all claims, damages, and liabilities arising out of your transactions with craknbam.

All personal information we collect is governed by our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes information about your use of the store in order to provide and improve the platform. Information you submit may be transferred to and shared with Shopify and other service providers, some of which operate in countries other than your own. By using the Services you confirm that you have read our Privacy Policy.

Section 12 — Feedback and Submissions

If you send us ideas, suggestions, reviews, photos, or other material ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display it in any medium and for any purpose, including commercial use. You confirm that you own or otherwise hold the rights to the Feedback, that you have disclosed any compensation you received in connection with it, and that it complies with these Terms. We are not obliged to keep Feedback confidential, to pay for it, or to respond to it, and we may remove any Feedback we consider unlawful or objectionable. You may not use a false identity or misrepresent the origin of any Feedback.

Section 13 — Errors and Inaccuracies

Content on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping costs, transit times, or availability. We reserve the right to correct such errors and to update information or cancel affected orders at any time without prior notice, including after an order has been submitted. Where an order is cancelled because of a pricing error after payment has been taken, we will refund you in full.

Section 14 — Prohibited Uses

You may use the Services only for lawful purposes. You may not use them: for any unlawful or malicious purpose; to breach any law or regulation; to infringe our intellectual property or that of others; to harass, abuse, or harm any person; to submit false or misleading information; to send spam or unsolicited promotional material; to impersonate any person or organisation; to upload malicious code; to harvest other people's personal information; or to interfere with or circumvent the security features of the Services. We may suspend or terminate your access without notice if we determine that you have breached these Terms.

Any software, bot, or automated agent that accesses the Services on a person's behalf must identify itself as automated, must not disguise itself as human in order to avoid detection, must not solve or bypass CAPTCHAs or other measures intended to separate automated from human traffic, and must respect any technical limits we place on automated access. We may end this agreement or your access to the Services at any time and at our sole discretion, without notice. You remain liable for any amounts owed up to the date of termination. The sections covering Intellectual Property, Feedback, Disputes and Chargebacks, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law survive termination.

Information on the Services is provided for general purposes only. We do not warrant that it is accurate, complete, or useful, and you rely on it at your own risk.

EXCEPT WHERE craknbam EXPRESSLY STATES OTHERWISE, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT REPRESENTATION, WARRANTY, OR CONDITION OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR FREE FROM ERROR. SOME JURISDICTIONS DO NOT PERMIT THE EXCLUSION OF CERTAIN WARRANTIES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

Section 18 — Limitation of Liability

IN EVERY CASE, OUR TOTAL AGGREGATE LIABILITY IN CONNECTION WITH ANY PRODUCT OR ORDER SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM.
